MountPay is a service of Snorrason Holdings ehf. MountPay contracts with businesses who provide online content ("Content Vendors" or "Vendors") and sells E-tickets to access their web sites for which you are purchasing Membership.
PLEASE NOTE: MountPay
is an Access Management Provider and E-ticket Supplier for online venues and does not have specific control over content offered by its Vendors; MountPay is not a publisher or editor of content and does not store Vendor's content on its servers.
We do however follow local laws regarding copyright infringement and the procedures prescribed by the Digital Millennium Copyright Act (DMCA) for notification, takedown, and counter-notification if, as a rights holder, you believe that one of our Vendors has infringed on your copyright(s). Please refer to the Copyright Infringement Procedure page here.
We do NOT take orders over the telephone, but if you have a question regarding an order you have placed, or are attempting to place, you may contact us on the toll fee telephone number given below.
THESE TERMS OF SALE APPLY TO ALL OF YOUR ONLINE PURCHASES FROM US AND CONSTITUTE THE ENTIRE AGREEMENT BETWEEN SNORRASON HOLDINGS EHF DBA "MOUNTPAY" AND YOU.
If supplemental terms for delivery of the E-ticket, and/or Refunds and Returns are offered by a specific Vendor in addition to these general Terms of Sale, such supplemental terms are incorporated herein by reference. Such supplemental terms will be listed above these general Terms of Sale during checkout with MountPay (as well as being viewable during checkout from the Delivery Policy and Refund Policy links). In the case of a contradiction between our general Terms of Sale and a Vendor's supplemental terms, these general MountPay Terms of Sale shall control.
These Terms of Sale may NOT be altered, supplemented, or amended by you, including by the addition of supplementary document(s) without our consent. Any attempt by you to alter, supplement or amend this document will be rendered null and void, unless such changes are otherwise agreed to in a separate and explicit written agreement signed by both you and MountPay.
Your purchase is subject to the terms of Icelandic Act No 46/2000 on Door-to-Door Sales and Distance Contracts (incorporating the relevant provisions of Directive 97/7/EC).
ACCEPTANCE AND CONSENT REGARDING PERSONAL INFORMATION
Bookmarking: The act of placing a Web Site URL into a temporary file within the Subscriber's browser so that the Subscriber may return to that page ("Bookmark") at a future date directly, without passing through any pages that may have preceded them.
Content Vendor: The owner or operator of the Vendor Site (or Vendor Sites) to which you are purchasing access.
E-ticket: The combination of a unique username and password that is used to access a Vendor Site.
An E-ticket is a license to use a Vendor Site (or Vendor Sites) for a specified period of time.
Member: You, the Subscriber, or user, of a valid E-ticket for the Vendor Site(s) during the term of Membership.
Membership: What you, the Subscriber, gain upon purchase of a valid E-ticket, that is access to a Vendor Site (or Vendor Sites). If you elected to be rebilled automatically by MountPay to keep your E-ticket valid you will be rebilled automatically by us when the subscription payment for access to the Web Site comes due, with prior notice by email.
Vendor Site or Web Site: The web site for which you are purchasing an E-ticket from MountPay in order to access that web site and its materials and obtain the benefits of Membership.
Subscriber: You, the end-user/consumer of the services of the Vendor Site and holder of a valid E-ticket generated by MountPay for the Vendor Site.
PRODUCT DESCRIPTIONS AND REMEDY
MountPay Vendors are responsible for writing the service descriptions for their respective services or products on their Web Sites. MountPay does not warrant that the service descriptions are accurate, complete, reliable, current, or error-free. (See the Delivery Policy and Cancellation, Refund and Return Policy sections below).
If you have any other questions regarding a purchase or if you do not recognize a charge on your payment card or bank statement, or you feel a charge has been made in error, please contact us on our toll fee telephone number for this purpose as given below.
SANCTION AND APPROVAL OF ADULT MATERIAL
The Vendor Site may be providing material or images intended for an age restricted audience. Access to Vendor Site is intended solely for people who are of legal age in the jurisdiction where Vendor Site is being viewed, and are at least 18 years of age (21 years in certain jurisdictions such as the US states of AL, MS, NE, and WY), who wish to access visual images, audio sounds, and verbal descriptions of a sexually oriented and frankly erotic nature. Materials available within Vendor Site may include depictions that are visually graphic in nature and portrayals of nudity or sexual acts and should not be accessed by anyone who is not of legal age in the jurisdiction where Vendor Site is being viewed and are at least 18 years of age in the US (21 years in certain jurisdictions such as the US states of AL, MS, NE, and WY), by anyone who finds such material offensive in nature, or by anyone who simply does not wish to be exposed to such materials.
By purchasing an E-ticket whether for one-off venue access or with ongoing pre-authorized recurring billing to maintain venue access, you are implicitly making the following statements:
"I affirm and swear that as of this moment, under penalty of Perjury, I am of legal age in the jurisdiction where Vendor Site is being viewed and am at least 18 years of age (21 years in certain jurisdictions such as the US states of AL, MS, NE, and WY). I will not permit any persons who are not of legal age in the jurisdiction where Vendor Site is being viewed, and who are not at least 18 years of age (21 years in certain jurisdictions such as the US states of AL, MS, NE, and WY) to view or access in any way any materials found on Vendor Site. I understand that by accessing Vendor Site, I will be exposed to materials that may include but are not limited to, visual images, audio sounds, and verbal descriptions of a sexually oriented and frankly erotic nature, portrayals of nudity, and even of sexual acts between consenting adults. I affirm that I am not offended by such materials, and that such materials are legal in my community. I am volunteering to view, hear, and access such materials of my own volition, and I choose to do so because I want to view/read/hear or otherwise access such materials for my own enjoyment, information or entertainment. My choice is a manifestation of my interest in such matters, which is healthy and normal, and is also held by most adults in my area. I am completely familiar with the standards held in my community, and the material I expect to access in Vendor Site falls within these standards. In my experience, the average adult in my community accepts the consumption of such materials by willing adults in circumstances such as this, which offer reasonable insulation from the materials for minors, and unwilling adults. Adults in my community will accept the standards displayed within Vendor Site, and will not find any of the material patently offensive."
If applicable, your purchase will be inclusive of VAT or other sales taxes.
The current payment methods available are: credit and debit cards from Visa, or MasterCard and by bank transfer or electronic check. Certain payment methods may be unavailable from time to time due to circumstances outside of MountPay's control. Orders are processed only after a billing address, and other billing information, including phone number and email address, are verified.
MountPay may for certain purchases attempt to contact the cardholder at their listed telephone number. Such contact will be made discreetly and with full consideration for your privacy. In cases where we are unable to contact the cardholder and confirm the order was placed by the cardholder we reserve the right to refund orders without notice.
All card details submitted as part of the Secure Socket Layer-secured checkout process on https://secure.mountpay.com are subject to an approval/screening process that is designed to identify any prior misuse, or abuse on the part of a purchasing customer in prior use of their card.
Under our rights of freedom of association we reserve the right to decline or refund an order from any credit/debit card or bank account number that has been subject to any prior inquiry (retrieval/copy request), refund, chargeback, or any other claim representing an outstanding loss to us, other merchants of our merchant service providers, or merchants who are members of the global anti-fraud networks to which we, or our merchant service providers, belong.
MountPay reserves the right to refund without notice, duplicate orders placed on the same day by the same cardholder. A duplicate order is deemed to be any order of the same final price (including tax or other charges) as an existing order placed with MountPay on the same day, regardless of having been placed with the same Vendor, or a different Vendor.
CURRENCY OF CHARGE
Charges are generally made to your card in one of USD (United States dollars) CAD (Canadian dollars), EUR (euros), GBP (British pounds), CHF (Swiss francs), JPY (Japanese Yen), DKK (Danish krona) or SEK (Swedish krona) or as indicated at checkout, regardless of the currency of your country of origin.
CARD ISSUER INTERNATIONAL SERVICE FEE
Certain card issuing banks may charge an "International Service Fee" regardless of whether or not a currency conversion is involved. This will appear on your card statement as a separate line item, such as "INTL Service Fee", "International Transaction Fee", "International Service Fee", "Foreign Transaction Fee", "Foreign Merchant Fee", "Foreign Transaction Charge", "Cross-border Assessment", or "International Service Assessment".
It is important to note that even if MountPay made the charge in the currency of your country and card account (such as USD, CAD, EUR, GBP, CHF, JPY, DKK or SEK) your issuing bank may still charge you this fee. This additional charge is NOT made by MountPay or its acquiring banks, but is made entirely at the discretion of, and to the profit of, your card issuing bank.
DELIVERY POLICY AND ELECTRONIC RECEIPT
E-tickets are provided
on the final MountPay confirmation screen and in the confirmation receipt sent to the Subscriber's email address provided to MountPay at checkout.
Should you encounter any difficulties with delivery of your E-ticket for login, in the first instance you should contact the Vendor's support service through the Vendor's website. If you are dissatisfied with the response from a Vendor, we offer below a toll fee telephone number, for order inquiries. Alternatively please contact us by opening a ticket within the MountPay ticket system from within the MountPay Customer Menu or directly via https://support.mountpay.com if you already have a login for an existing ticket opened from within the Customer Menu.
Subscriber may, at any time, request a copy of charges made during the life of their Membership(s) to the Vendor Site(s) by logging into the Customer Menu at MountPay's secure website.

CANCELLATION, REFUND AND RETURN POLICY
At any time, and without cause, Membership to the Web Site may be terminated by either MountPay, the Web Site, or the Subscriber upon notification to the other by electronic or conventional mail, or by telephone. When the Member requests the termination, existing Membership fees are NOT refunded. Subscribers are liable for charges incurred by them until termination of service.
Any refunds can only be made to the same card number or bank account that was used to place the original order.
If you need to cancel your order, in the first instance you should contact the Vendor through the MountPay ticket system, or through the Vendor's Web Site as shown in the MountPay confirmation email.
Should you encounter any difficulties with cancellation of your order please contact us toll fee on the telephone number for this purpose as given below or open a MountPay support ticket with us.
If you believe you were rebilled in error for a "special introductory offer" please contact us using the toll free number provided below.
(If you phone in please have your MountPay order number (in xxxxxx.yyyyyyy format, i.e. 399999.1234567) and other details ready, which you will find in the order confirmation email you will have received from MountPay after you completed the checkout process.)
"Free Trials" and Reserved Funds
If you are taking advantage of a "Free" trial period through a credit or debit card, please be aware of the following:
MountPay may request and your bank may immediately put a "Reserved Funds" authorization hold on your credit or debit card for the amount of the Membership plan you have selected. If the free trial is cancelled within the timeframe allowed by the Web Site (for example within three days), it typically takes the banking system up to ten (10) days to remove the hold on these funds unless you contact your issuing bank. Please kindly note that MountPay has no way to remove this hold, only your card issuing bank or financial institution can. During the trial period and for a minimum of seven (7) to ten (10) days after you cancel, these funds may be unavailable even though technically they have not been charged, and you could overdraw or exceed the limits of your account. You are responsible for communicating with your bank and for any charges imposed by your payment card issuing bank for exceeding your account limits or overdrawing your account.
PRE-AUTHORIZED RECURRING BILLING (If Selected By You On the Sign Up Page)
If you elected to be rebilled automatically for a Membership under a continuity plan, you will be notified
by email ten (10) days before the rebilling, and also at the time the rebilling is made.
You may login to your transaction at the MountPay Customer Menu at any time to deactivate a future rebilling, or update the card details to be used for the rebilling.
Subscription fees will be automatically renewed at the end of the original term selected, for a similar period of time, unless notice is received from the Subscriber seven (7) days before renewal.
All special introductory offer Members shall be exempt from the seven (7) day notification requirement, but Subscriber must either cancel and deactivate the recurring billing from the MountPay Customer Menu themselves, or notify MountPay directly twenty-four (24) hours prior to the end of the trial/special offer period in order for MountPay to cancel the automatic renewal on their behalf.
All trial/special offer memberships shall renew at the agreed to Membership rate. The maximum term of this agreement is 100 months.
Unless and until this agreement is cancelled in accordance with the terms hereof, Subscriber hereby authorizes MountPay to charge Subscriber's chosen payment method to pay for the ongoing cost of Membership.
ON DEMAND BILLING (If Selected By You From Time to Time)
Subscriber hereby further authorizes MountPay to charge Subscriber's chosen payment method for any and all additional purchases of services and entertainment they may make that are provided by the Web Site, On Demand of the Subscriber from time to time. In such a case the customer will be asked to confirm the additional purchase, and re-enter their billing details securely under SSL on https://secure.mountpay.com and an additional confirmation receipt email will be sent.
Subscriber agrees that no time will they Bookmark any page to the Site that will allow the Subscriber or user of the computer concerned to bypass the terms and conditions of the Web Site upon entering. If such a Bookmark exists, said Bookmark will constitute full agreement to said terms and conditions as well as to affirm that Subscriber is of legal age of majority in their state, country, or region.
AUTHORIZATION OF USE
Subscribers to a Web Site are hereby authorized a single E-ticket to access the service or material located at the Web Site (or Web Sites). This E-ticket shall be granted for the sole use of one Subscriber. All memberships are provided for personal use and shall not be used for any commercial purposes or by any commercial entities. Commercial use of either the Web Site or any material found within is strictly prohibited unless authorized in writing by the Web Site. No material within the Web Site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified, or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices.
MountPay and theWeb Site reserve the right to terminate an E-ticket at any time if the terms of this agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from the Web Site or Web Sites involved.
LIMITED WARRANTY AND DISCLAIMER
MountPay Content Vendors may provide a limited warranty for their services.
MOUNTPAY PROVIDES NO SEPARATE WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOUNTPAY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING ANY PRODUCTS OR SERVICES SOLD TO YOU, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.
LIMITATIONS OF LIABILITY
MOUNTPAY DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS OR SERVICES NOT BEING AVAILABLE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. MOUNTPAY WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, DIRECT, INDIRECT, OR STATUTORY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS (OR SERVICES BUNDLED WITH THE PRODUCTS), WHETHER FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, MOUNTPAY SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE AMOUNT PAID BY YOU FOR THE PURCHASE OF PRODUCTS OR SERVICES UNDER THESE TERMS OF SALE GIVING RISE TO SUCH LIABILITY.
You agree to defend and indemnify MountPay and its employees and Content Vendors from any claim or demand, including attorney's fees, arising from your failure to comply with these Terms of Sale, your violation of any law, or violation of the rights of a third party.
JURISDICTION, VENUE, STATUTE OF LIMITATIONS
These Terms of Sale shall be governed by the laws of the Republic of Iceland. You agree that any action at law or in equity arising out of or relating to these Terms of Sale, or the Services of MountPay shall be filed exclusively in the courts of the Republic of Iceland, and you hereby consent and submit to the personal jurisdiction of such courts.
You agree that in addition to your obligations under these Terms of Sale it is the cardholder's responsibility to ensure that they are permitted by the laws and regulations of their local jurisidiction to purchase the services from MountPay, including but not limited to requirements that you have reached a certain minimum age to be permitted to purchase the online venue access provided by MountPay.
You agree that regardless of any law or statute to the contrary, any claim or cause of action arising out of or relating to this website, these Terms of Sale, or the Services of MountPay must be filed within one (1) year of the date the cause of action arose or be deemed waived and forever barred as untimely.
If any provision of these Terms of Sale is held to be invalid or unenforceable, in whole or in part, such holding shall not affect the validity or enforceability of the other provisions of these Terms of Sale, and any part of such provision not held invalid or unenforceable shall remain in full effect.
If such holding of invalidity or unenforceability is based on a measure of liability, performance, or time set as a standard in these Terms of Sale, such provision shall be replaced by a legally valid measure of liability, performance, or time which is as close as possible to that originally specified and intended.
Notwithstanding anything herein to the contrary, the "Limited Warranty", "Limitation of Liability" and "Indemnification" language shall survive the termination of these Terms of Sale.
The provisions of these Terms of Sale will inure to the benefit of and be binding upon MountPay and its successors and assigns, and you and your heirs, executors, administrators, successors, and personal representatives, and all persons you represent and their respective successors, assigns and related persons.
You and/or persons you represent may not assign your rights and obligations under these Terms of Sale without the express prior written consent of MountPay, which may be withheld at MountPay's sole discretion.
MountPay may assign these Terms of Sale and its rights and obligations under these Terms of Sale without your consent or the consent of any persons you represent, in order to deliver the products or services ordered, and for any other purpose within the scope of these Terms of Sale.
MOUNTPAY'S FAILURE TO ENFORCE ANY PROVISION OF THE TERMS OF SALE OR TO ACT WITH RESPECT TO A BREACH OF THE TERMS OF SALE BY YOU SHALL NOT BE DEEMED A WAIVER OF SUCH PROVISION NOR OF MOUNTPAY'S RIGHT TO ACT WITH RESPECT TO SUBSEQUENT OR SIMILAR BREACHES, NOR OF MOUNTPAY'S RIGHT TO ENFORCE SUCH PROVISION. HOWEVER, BOTH PARTIES ARE EXPECTED TO ACT REASONABLY.
